Dosell AB (hereinafter Dosell) Terms of Use, etc.

Dosell is the data controller for the processing of personal data necessary to provide your services according to the Agreement. You can learn more about how we process your personal data at dosell.se/privacy-policy/. Here, we inform you about the processing, purposes, legal basis, and duration of data storage. We also provide information on how you can influence the processing by exercising your rights, such as correction, deletion, objections, and portability. Additionally, you’ll find details on how to contact us with questions about data handling and whom to turn to if you are dissatisfied with our handling.

These terms apply between Dosell and you, the user of Dosell’s services.

  1. Introduction

Thank you for choosing Dosell. Dosell is a patented medication dispenser for safer home medication and for residents in elderly care homes.

By automatically dispensing pills into pouches at prescribed times, Dosell ensures you receive your medication at the right moment. Dosell sends reminders for medication and can alert designated contacts if medication is missed. This way, Dosell can reduce the risk of overdosing, taking the wrong combination of medications, or missing medication altogether.

Your agreement with us includes these Terms and any additional terms you accept, as outlined in the Complete Agreement section below (collectively referred to as “Agreements”). The Agreements cover conditions regarding future changes, export control, automatic renewals, liability limitations, privacy protection, waiver of class action, and dispute resolution through arbitration instead of court. By using Dosell, you confirm that you have read and understood the Agreements, accept them, and agree to be bound by them. If you are not willing to be bound by (or cannot fulfill) the Agreements, you cannot use Dosell.

To use the Service and access the Content, you must (1) meet the age requirements in the table below, (2) have the authority to enter into a binding agreement with us and not be prevented from doing so under applicable law, and (3) reside in a country where the Service is available. You also promise and warrant that all information you provide to Dosell during registration is true, accurate, and complete, and you agree to ensure it remains so.

  1. Term and Termination

The Agreements will continue to apply until terminated by you or Dosell. However, you acknowledge and accept that the perpetual license granted by you regarding User Content, including Feedback, is irrevocable and will continue to apply after the termination of any of the Agreements, regardless of the reason. Dosell has the right to terminate the Agreements or suspend your access to the Service at any time, including if you have used the Service and/or Content improperly, failed to comply with the Agreements, or if we discontinue the Service and/or Content (in such case, we will provide notice reasonably before termination). If you or Dosell terminates the Agreements, or if Dosell suspends your access to the Service, you agree that Dosell, to the fullest extent permitted by applicable law, has no liability or obligations to you, and Dosell will not refund any amounts you have already paid. You can terminate the Agreements at any time. If you want to know how to terminate the Service, please contact us. If you wish to terminate the Service due to alleged misunderstandings in functionality or that the Service needs/needed service or an update, Dosell offers a service/update or replacement of the device, please contact us. This section will apply to the extent permitted by applicable law.

  1. Changes to the Agreement

From time to time, we may make changes to the Agreements, such as improving existing features or adding new features to the Service, implementing scientific and technical developments, and making reasonable technical adjustments to ensure the operation or security of the Service for legal or regulatory reasons. When we make substantial changes to the Agreements, we will provide you with notice appropriate to the circumstances, such as a clear notice or by seeking your approval within the Service or by sending an email to you. In some cases, we will notify you in advance, and your continued use of the Service after the changes have been made will constitute your acceptance of the changes. Therefore, we ask you to read all such notices carefully. If you do not wish to continue using the Service in accordance with the new version of the Agreements, you can terminate your account by contacting us. If you have obtained a Trial Subscription or a Paid Subscription through a third party, you must terminate the applicable Paid Subscription through that third party.

  1. Limitations and Interruptions in the Services

4.1 The network and its coverage have certain limitations, which may result in occasional dissatisfaction with availability. For questions or comments, please contact customer service. Dosell’s services operate on the 2G network with a SIM card.

4.2 In some cases, the Product may need to be upgraded for the Services to function optimally, such as for improvements and/or updates. Dosell has the right to limit the availability of the Service to the extent necessary due to expansion or for technical, maintenance, or operational reasons. Dosell will seek to minimize downtime and take necessary measures to cause the least possible inconvenience to you. Dosell will, to the greatest extent possible, inform you of planned interruptions.

  1. What You Must Do

You are responsible for keeping user data and passwords secure and ensuring unauthorized access. You may not copy, interfere with, or manipulate your Product.

  1. Responsible Use of the Services

6.1 You may only use the Services: (a) in accordance with the Agreement and for the purpose stated in the Agreement, and (b) for your own personal use, i.e., you may not resell or commercially use the Services. (c) in accordance with the user manual.

6.2 You may not use the Services, or allow anyone else to use the Services, for illegal or unethical purposes or in a way that causes harm or inconvenience to Dosell or any third party. For example, you may not use or allow anyone else to use the Services: (a) for fraudulent or illegal activities, (b) to copy, store, modify, forward, or publish the Services or their Content, unless we have expressly permitted it in writing, (c) in any way that violates someone else’s rights, such as copyright or other intellectual property rights.

  1. Payments, Termination, and Right of Withdrawal

7.1 Billing

A Paid Subscription can be purchased directly from Dosell or through a third party, either (1) by paying a monthly subscription fee or another recurring interval as we notify you before the purchase; or (2) by prepayment that gives you access to the Service for a certain period (the “Prepaid Period”).

Dosell may change the price of the Paid Subscription from time to time, including recurring subscription fees, the Prepaid Period (for periods not yet paid), or Codes, and will communicate any price changes to you in advance and, if applicable, how these changes are accepted. Price changes take effect at the beginning of the next subscription period the day after the price change occurred. To the extent permitted by applicable law, you accept the new price by continuing to use the Service after the price change takes effect. If you object to a price change, you have the right to reject the change by terminating your subscription to the Service before the price change takes effect.

If you purchase a Paid Subscription, you agree that Dosell can automatically charge you every month until you terminate the Paid Subscription. You accept that the Right of Withdrawal is available for fourteen (14) days from the day you made the purchase but is lost as soon as you start using the Service during this period.

7.2 Renewal; Termination

Unless your Paid Subscription has been purchased as a Prepaid Period, your payment to Dosell, or the third party through which you purchased the Paid Subscription, will be made automatically at the end of each subscription period unless you terminate your Paid Subscription before the end of the current subscription period. Termination becomes effective the day after the last day of the current subscription period. If you cancel your payment or terminate your Paid Subscription and/or terminate any of the Agreements (1) after the Right of Withdrawal has expired (if applicable), or (2) before the end of the current subscription period, we will not refund any subscription fees already paid to us. The method of refund depends on the payment method. If you want to terminate the Paid Subscription during the Right of Withdrawal according to the above terms, you must contact us by email at the address specified in section 11 (Contact Us). Alternatively, you can use the standard termination form available at www.konsumentverket.se and send it by mail [or email] to the address specified in section 11 (Contact Us). If you want a full refund of all fees paid to Dosell before the Right of Withdrawal expires, you must contact Customer Service. When processing any refunds, we will refund amounts using the method you used for payment.

If you have purchased a Paid Subscription using a Code, your Paid Subscription will automatically cease at the end of the period specified for the Code, or when the prepaid balance is not sufficient to pay for the Service. If you have purchased your Paid Subscription through a third party, you must terminate your subscription directly with the third party.

7.3 Right of Withdrawal and Returns

We offer our customers a 14-day Right of Withdrawal from the day you received your order. If you want to exercise your Right of Withdrawal, please contact us via . The item must be returned in its original packaging and in unused condition. The cost of the return shipping is paid by you. We will refund the item’s price within 14 days of receiving and approving the return.

  1. Intellectual Property Rights

8.1 All intellectual property rights, such as copyright, patents, etc., concerning the Services and their Content belong to Dosell or the partners we have agreements with.

8.2 The trademarks Dosell and other logos, trademarks, or images on the Products and Services belong to Dosell or Dosell’s collaborative partners.

8.3 You may not, unless expressly permitted by Dosell in writing, use, copy, or otherwise handle software or other materials belonging to the Services, nor transfer or license the right to such software or material to another.

  1. Liability

9.1 We are not responsible for inconvenience, damages, or losses caused by interruptions or disturbances in the Network, if the error or delay is due to something beyond our control or could not have been foreseen.

9.2 If the Network has not functioned satisfactorily because a technical, maintenance, or operational measure has been needed due to something beyond our control or could not have been foreseen, we are not obligated to compensate for any damages.

9.3 We are not responsible for the networks of operators.

9.4 If we cannot fulfill an obligation to you due to circumstances beyond our control or could not have been foreseen, we are exempt from damages and other consequences.

Such circumstances include, among other things, lightning strikes, fire, government regulations, or other public regulations, errors in the operator’s network, widespread labor disputes, and general shortages of transport, goods, or energy. A corresponding limitation of liability, so-called force majeure, also applies to you in relation to Dosell.

9.5 The above provisions on limitation of liability also apply after the Agreement has expired.

  1. Notices

You may receive messages from Dosell via SMS, email, or mail. We use the contact information you provided to Dosell. If your information changes, such as email address, home address, or name change, it is important that you immediately inform Dosell.

  1. User Responsibility To ensure that Dosell is used safely, the following user conditions must always be met.

11.1 It is always the user or person responsible for medication who has the ultimate responsibility to ensure that the user receives the right medication at the right time.

11.2 Dosell is a complementary dispensing aid for individuals who have already been prescribed pouches.

11.3 The user or person responsible for medication must be able to determine, at each dispensing, whether Dosell has dispensed the pouch on the date and time printed on the pouch’s label, before taking the dose.

11.4 The user or person responsible for medication must be able to identify a failed or missed dispensing based on the user’s normal medication interval.

11.5 If either of the two situations above occurs, the user or person responsible for medication, when in doubt about how the error can be corrected, must be able to seek assistance from the prescribing doctor or person responsible for medication.

11.6 I am solely responsible for purchasing medication for use in the device, and Dosell is not responsible for any use, misuse, or claims related to medication. The Dosell device is intended to assist me in taking medication prescribed to me, and I agree that I will monitor all medications I take and confirm the correct dosage and type of medication before taking them, regardless of what the Dosell device may provide me.

  1. Safety Regulations

Carefully read the following warnings and safety regulations before using Dosell.

12.1 Dosell may only be used indoors at normal air pressure (between 500 and 1060 hPa) and normal humidity (between 10% and 65%).

12.2 Dosell must not be used in environments where the temperature falls below 0 °C or exceeds +35°C. If Dosell has been stored outside this range before use, it must be unpacked and kept at room temperature for at least 2 hours before starting.

12.3 Dosell may only be used with dosing bags verified and approved by Dosell AB, where both the bag and its content withstand the aforementioned indoor environment.

12.4 For the current list of approved dosing bags, see www.dosell.se.

12.5 Dosell is intended to dispense dosing bags according to prescription.

12.6 Dosell may only be used with dosing rolls measuring up to 160 millimeters in diameter.

12.7 Dosell must not be exposed to water or used in damp environments, such as bathrooms or in close proximity to a sink.

12.8 Dosell (including the accompanying power adapter) must be placed out of reach of children. The power adapter’s cord can pose a risk of strangulation.

12.9 Dosell must not be covered.

12.10 Dosell must not be disassembled or modified in any way.

12.11 Dosell must not be connected to accessories other than those described in the manual.

12.12 Dosell may only be used with the accompanying power adapter. If the power adapter is lost or damaged, a new one can be ordered from the place of purchase.

12.13 Dosell must only be used mounted upright on the accompanying table stand, or the console on the stand can be detached to be wall-mounted.

12.14 Service on Dosell may only be performed by Dosell AB or technicians approved by Dosell AB.

  1. Legal Authority I accept these terms as the person who will use the device, or if not, I am duly authorized to accept these terms on behalf of the person who will use the device.
